Terms & Conditions

1. Acceptance of Terms

By creating an account, purchasing a product, or using any feature of the CardLinks platform (including cardlinks.app, app.cardlinks.app, tap.cardlinks.app, or any associated mobile application), you ("User," "you") agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

CardLinks LLC ("CardLinks," "we," "our," or "us") reserves the right to update these Terms at any time. Continued use after an update constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. By using the Service, you represent that you meet this requirement. Business accounts may be created on behalf of a legal entity by an authorized representative.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and current information when registering.
  • Notify us immediately at support@cardlinks.app if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

4.1 Subscription Plans

CardLinks offers annual subscription plans that unlock features including profile customization, analytics, and the Referral Rewards program. Pricing and features are described on the pricing page and may be updated at any time; changes will not affect your current billing cycle.

4.2 Billing

Subscriptions are billed annually in advance. Payment is processed by our payment processor. By subscribing, you authorize us to charge your payment method on each renewal date. You will receive a receipt via email.

4.3 Cancellation

You may cancel your subscription at any time from the app settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. We do not provide prorated refunds for partial subscription periods except as required by law.

4.4 Free Trials

If a free trial is offered, it will convert to a paid subscription automatically at the end of the trial period unless you cancel before that date. We will notify you before a trial converts.

5. Physical Card Orders

  • Physical NFC cards are custom-manufactured goods. All sales are final once the card has been provisioned or shipped.
  • We are not responsible for delays or losses caused by shipping carriers once the order has been handed to the carrier.
  • Defective cards (manufacturing defects, NFC chip failure on delivery) will be replaced at no charge. Contact support within 14 days of delivery.
  • NFC cards are designed for personal or business use only. You may not resell or distribute our physical cards without written authorization from CardLinks.
  • Engraving and customization options, once submitted, cannot be changed. Review your order carefully before confirming.

6. Referral Rewards Program

  • Participation in the Referral Rewards program is subject to these Terms and any additional program-specific rules displayed in the app or on the program page.
  • Referral rewards are issued only for verified referral events as determined by CardLinks' tracking system. We are the final authority on whether a referral qualifies.
  • Rewards have no cash value unless explicitly stated. They cannot be transferred, sold, or exchanged for cash except as described in the program.
  • We reserve the right to modify, suspend, or terminate the Referral Rewards program at any time. Earned rewards will be honored for 90 days following program termination.
  • Fraud, manipulation of referral tracking, or self-referral is prohibited and may result in account termination and forfeiture of all rewards.

7. User Content

You retain ownership of the content you submit to your CardLinks profile ("User Content"). By submitting User Content, you grant CardLinks a non-exclusive, worldwide, royalty-free license to store, display, and distribute that content solely for the purpose of operating and improving the Service.

You agree not to post User Content that:

  • Infringes any third party's intellectual property or privacy rights.
  • Is defamatory, harassing, obscene, or otherwise unlawful.
  • Contains malware, phishing links, or deceptive content.
  • Impersonates another person or entity.
  • Violates any applicable law or regulation.

We reserve the right to remove User Content that violates these Terms without prior notice.

8. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated tools (bots, scrapers) to access or harvest data from the Service.
  • Interfere with the operation of the Service or any servers or networks connected to it.
  • Attempt to circumvent authentication, access controls, or rate limits.
  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.

9. Intellectual Property

All elements of the CardLinks Service — including the software, design, trademarks, logos, and written content — are owned by CardLinks LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. NFC card functionality depends on hardware and software compatibility outside our control. We do not guarantee that tap events will be recorded in all circumstances.

The Referral Rewards program is a business tool — we make no guarantees regarding the number of referrals you will receive or the revenue impact of the program.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDLINKS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CARDLINKS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify and hold harmless CardLinks LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 9–13 of these Terms survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration in Stratford, Connecticut under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property or data security matters.
